Price-fixing seems to be in the air these days. But the good news is that the law is on your side, and Canadians have 38 million reasons to celebrate. That’s because one of the biggest price-fixing settlements in Canada has been reached and it’s time for YOU to collect.
You know that foam you might find in furniture, mattresses and carpet underlay? Well, that’s often made of polyurethane and, as it turns out, between 1999 and 2012 several manufacturers of polyurethane foam products allegedly formed a cartel — yeah, a cartel! — to fix prices.
This meant Canadian consumers paid inflated costs for products made with this kind of foam. We were scammed!
There’s now a Foam for Cash campaign to get Canadians what they are owed: a minimum of $20 per household. Better still, claim your money to help send the message that collusion and cheating consumers has serious consequences and no place in our country. Send the message that we want fair and healthy competition between manufacturers.
It is SO EASY for Canadians to collect their share of the settlement money.
Who is eligible for the Foam for Cash compensation?
You’re automatically considered a Class Member and can complete a claim form if you:
- Live in Canada now or you lived in Canada between January 1, 1999, and January 10, 2012; and
- While in Canada, bought flexible polyurethane foam, eligible foam products or carpet underlay made in Canada for personal, commercial or manufacturing use during the same time period
Which polyurethane foam products qualify?
“Flexible” polyurethane foam refers to a type of foam used in furniture, mattresses, carpet underlay and more. You can make a claim not only for the purchase of flexible polyurethane foam made in Canada, but also for the purchase of the following eligible foam products, if they were made in Canada:
- Bed mattresses
- Upholstered office chairs
- Upholstered Armchairs
- Two-seat sofas
- Three-seat sofas and sectional sofas
- Carpet underlay
- Carpet pad
- Carpet cushion
Claim your Foam for Cash money in 3 easy steps:
- Fill out the online form and submit the required documentation no later than February 6, 2018.
- To file a claim, click here.
- For consumer claims, members of the same family living together must pool together their purchases in a single claim.
How much can I claim?
The minimum amount consumers may be eligible to claim is $20; it could be more, depending on the number and type of eligible Canadian-made foam products you purchased.
You either need to fill out a simplified claim form (to claim $20) or a standard claim form (to claim more than $20). Use the online calculator to decide which form is best for you.
Manufacturers who purchased flexible polyurethane foam to make products and resellers who purchased flexible polyurethane foam or foam products for resale may also be entitled to compensation. They can fill out the standard claim form here instead.
In every case, the amounts received by Class Members will depend on the volume and type of Canadian-made flexible polyurethane foam or eligible foam products purchased as well as the total volume of claimants — but, hey, GO FOR IT.
